Note that privately owned object may have access values other than access=private and that access=private may appear on objects that are not owned privately.

For example private plot may be access=permissive or have legally binding right of public way.

Footway on a privately owned land, could be tagged as ownership=. Way itself is a right of public way tagged with highway=footway + foot=designated + designation=public_footpath
